Terms & Conditions

1. Scope

These Terms and Conditions apply to the use of the SkillMatch app and the business relationship between SkillMatch, the companies Damapril GmbH (Haselweg 8, 6005 Lucerne) and Dinnova AG (Bahnhofplatz 1, CH-8001 Zurich), hereinafter referred to as the “operator”, and its customers (hereinafter referred to as “customer”). The version of the Terms and Conditions available at the time of using the app shall apply. The service is available to customers worldwide.

A customer is any natural or legal person using the SkillMatch app. These Terms and Conditions, delivery and payment conditions, and the privacy policy may be amended from time to time. The provider requests that users read these provisions carefully each time they use the app.

These Terms and Conditions apply exclusively. Conflicting, supplementary, or deviating terms and conditions shall only apply if expressly confirmed in writing by the provider. By using the app, the customer confirms full acceptance of these Terms and Conditions, including delivery and payment terms.

If any provision of these Terms and Conditions is or becomes invalid or unenforceable, the validity of the remaining provisions shall not be affected.

The operator of this app is Dinnova AG (see legal notice).

2. Information in the App / Use of the App

The aim of the app is to connect various service providers in the form of a barter exchange. SkillMatch itself does not provide services and is therefore not active within the app.

The offers depend entirely on the users of the SkillMatch app and are not pre-verified. Users are obliged to provide truthful, realistic, and secure information regarding their offers and capabilities. The app operator acts solely as a mediator and is not responsible for the services and offers exchanged. There are chat rooms between users in the app: these chats are not pre-moderated or monitored in any way.

Some services may include consumables. Payment for these must be agreed upon in advance between users.

Once a match is confirmed, users must comply with the agreed terms. Failure to fulfill obligations will result in account deletion and exclusion from the app.

3. Subscriptions and Pricing

Membership, and therefore inclusion in the community, is activated by purchasing a subscription. Only a subscription entitles you to membership and thus use of the SkillMatch app. Renewing the subscription before it expires guarantees uninterrupted use of the app and its features. Termination of the subscription does not release the user from responsibility for one or more services already agreed upon with other users.

The subscription price is fixed, and there are different types with varying durations and prices. Prices and durations can be changed at any time and are not retroactive. It is possible that ad-hoc offers at different prices may be made to certain groups of potential users or individual active/inactive users.

4. User Obligations

Conduct: Users are required to communicate respectfully and honestly.

Users are responsible for the quality, execution, and legality of the services offered or sought, and for complying with all applicable laws.

Users are not permitted to offer and/or provide sexual services within SkillMatch. The app is not intended to be used as a platform for propaganda or proselytism.

5. Liability

The operator is not liable for content posted by users or for the quality and execution of services agreed upon between users.

Responsibility lies entirely with the users, both in terms of the services provided through the app and the use of the app.

7. Termination and Blocking

Termination by users: Users can delete their account at any time without providing reasons. This option is excluded in cases of: outstanding service obligations; agreed services that have not yet been fulfilled.

Termination by the operator: The operator may block or delete user accounts if they violate the Terms and Conditions.

8. Other Provisions

The operator expressly reserves the right to amend these Terms and Conditions at any time and to put them into effect without prior notice.

In the event of disputes, only substantive Swiss law shall apply, excluding conflict of law provisions.

The place of jurisdiction is Zurich, unless mandatory legal jurisdictions apply.
